1. This Site is provided by Danone for the purpose of offering information and communication. You are free to browse this Site.

2. The content on this Site is provided in compliance with Malaysian laws and regulations and is intended for use by Malaysian residents only. Danone makes no representation that the information on this Site is relevant or suitable for use elsewhere.

3. This website offers you a channel to obtain information about Danone’s range of formula milk products. If you choose to view this information, you agree that Danone provides this information at your own choice for informational purposes.

4. Once your registration process is complete, you should have identified a username and password. You must ensure that your username and password are kept secure and not disclosed to anyone. You are fully responsible for all activities that occur under your username and password. It is your responsibility to report to us any unauthorized use of your username and password or any security breaches as soon as you become aware of them. We reserve the right to require users to change their username and password if necessary for security purposes.

5. All accounts must be registered with a valid personal email address that you access regularly so that email notifications can be sent to you. Accounts registered with someone else’s email address or temporary email addresses may be canceled without prior notice. We reserve the right to cancel accounts if Users are found using IP addresses to attempt to hide the use of multiple Danone accounts, or if a User who is not based in Malaysia pretends to be a Malaysia-based User, or interferes with any of our services in any way.

6. Use of this Site is at your own risk. Danone and/or its affiliated companies make no representations regarding the suitability, accuracy, reliability, or completeness of the information and materials contained on this Site for any purpose and will not be liable for any errors or omissions contained in the Content or any other information available, directly or indirectly, on this Site. Neither Danone nor any party involved in creating, publishing, or operating this Site shall be liable for any direct, incidental, consequential, indirect, or punitive damages, whether in contract, negligence, or tort, arising from your access to or use of this Site and its Content, including any Third-Party Websites (as stated below). This includes damage to or viruses that may infect your computer hardware and/or electronic devices. You agree to indemnify, defend, and hold Danone harmless from and against any claims, including but not limited to defamation, privacy, and intellectual property infringement. Without limiting the foregoing, all information contained on this Site is provided to you on an “as is” basis and without any warranty of any kind, whether express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. The copyright of the content on this Site belongs to Danone. Users may download materials for personal, non-commercial use, provided that all copyright and proprietary notices are preserved. Copying, distributing, uploading, printing, transferring, or modifying any part of the website for public or commercial purposes is not permitted without prior written consent from Danone. When you submit or post any material on or to this Site, you grant Danone a non-exclusive, worldwide, perpetual, royalty-free, fully sublicensable license under your ownership and intellectual property rights to use, reproduce, modify, adapt, print, translate, create derivative works from, display, or distribute such material worldwide through the Site or in any manner without any obligation to account to you. You acknowledge that you are responsible for any material posted on this Site. This means you (and not us) are fully responsible for the material submitted, including its legality, reliability, appropriateness, and ensuring that it does not infringe anyone’s intellectual property rights or breach anyone’s confidence.

8. All trademarks, logos, characters, or service marks (collectively “Trademarks”) displayed on the Site, whether registered or unregistered, are owned exclusively by Danone. Nothing contained on this Site shall be construed as granting any rights by implication, estoppel, or otherwise, any license or right in or to the Trademarks without prior written consent from Danone. Your use of the Trademarks and the content of this Site, except as stated in these Terms and Conditions, is strictly prohibited. You are advised that Danone will fully enforce its intellectual property rights in all Trademarks, this Site, and its content to the fullest extent of the law, including seeking criminal sanctions.

Various information, advice, recommendations, letters, messages, comments, posts, text, graphics, software, music, audio, images, video, data, samples, and other materials (collectively “Content”) may be available in and through this Site. Some of the Content is provided by Danone, and some by Users, such as opinions and views through questions and answers or posts. Danone strives to ensure that the Content we place and provide on the Site is accurate, comprehensive, and up-to-date, but we cannot guarantee or be responsible for the accuracy, integrity, quality, completeness, or timeliness, or that it may not be objectionable to you, of Content provided by us or any User. To ensure everyone can enjoy all the features of this website, please read and comply with the Code of Proper Conduct (as described below).

10. Images of people or places displayed on the Site are owned by, or used with permission from, Danone. Your use of these images is prohibited unless specifically permitted under these Terms and Conditions or through explicit permission on this Site. Unauthorized use of these images may violate copyright, trademark, and/or publicity laws as well as communication regulations and statutes.

11. If you wish to bring to our attention any illegal activity regarding Content posted by other Users or available on this Site and would like to file a complaint with us, please use the ‘report abuse’ link found on the page containing the User-provided Content.

12. Content displayed on this Site or provided by our Careline staff is based on the understanding that neither Danone nor its Users are engaged in providing medical, counseling, legal, or other professional services or advice. The Content on this Site or provided by our Careline staff is for informational purposes only and not as medical or healthcare advice or a substitute for professional advice regarding specific conditions or questions about any medical or legal issues. Always seek advice from your family doctor, pediatrician, or other healthcare professionals regarding medical conditions before starting any new treatment.

13. Personal information you voluntarily provide to Danone through the Site, such as interactive registration and sample requests, may be used by Danone Dumex in accordance with Danone’s Privacy Policy (available here: Privacy Policy). It may be used for internal Site access purposes and to meet our customer needs. By providing such information, you expressly agree that Danone may use your personal information for these purposes and as stated in Danone’s Privacy Policy.

14. Danone advises you not to disclose any personal information about yourself or others (for example: phone numbers, mailing addresses, home addresses, email addresses, or any information that could identify you) in any Danone community. Danone will not be responsible for any circumstances or consequences arising from personal information voluntarily disclosed by you. While Danone takes all appropriate and reasonable steps to protect your personal information, Danone cannot guarantee that any transmission of your personal data over the internet is 100% secure and reserves the right to disclaim any liability for losses incurred if personal information is stolen, hacked, lost, or damaged due to accidents or otherwise.

15. This Site may contain links to other third-party websites (“Third-Party Websites”). Danone is not responsible for the content or credibility of Third-Party Websites or for ongoing reviews of other Third-Party Websites. Links provided to Third-Party Websites should not be considered endorsements by Danone. Access to any linked Third-Party Website is at your own risk. Danone advises you to exercise caution when leaving our Site and to read the terms and conditions on the Third-Party Website. These Terms and Conditions apply only to information obtained by Danone on this Site. Hyperlinking to this Site, in any manner, is not permitted without prior written consent from Danone.

16. Danone makes no representation or warranty that this Site or any linked Third-Party Website will be accessible or available at all times, or that access will be uninterrupted or error-free.

17. Danone reserves the right to modify or delete content from this Site at any time without prior notice. Information displayed on this Site may contain typographical errors or technical inaccuracies. Such information may be updated from time to time. Danone may make improvements and/or changes to the products described herein at any time and from time to time.

18. Danone may, at any time, amend these Terms and Conditions by updating this page. You are bound by such changes and should therefore visit this page periodically to understand the latest Terms and Conditions.

19. Danone reserves the right to deny or restrict access to this Site to specific individuals or block access from certain Internet addresses at any time without providing any reason.

20. These Terms and Conditions are governed by and interpreted in accordance with Malaysian law, and any disputes shall be submitted to the exclusive jurisdiction of the Courts of Malaysia.

1. During your chat session, you can request a transcript of the conversation by clicking the printer or envelope icon located at the top of the chat window.

2. Danone and its affiliates shall not be liable for any direct, incidental, consequential, indirect, or punitive damages arising from advice obtained through “Live Chat” conversations or community sharing. For any specific medical advice, you are advised to consult your own doctor or healthcare advisor.

3. Danone will retain transcripts of every chat conducted via “Live Chat.” These transcripts will be stored for 24 months by Danone and will be used for training, quality assessment, and in cases where customers lodge complaints regarding the “Live Chat” service.

4. All “Live Chat” conversations will be conducted through secure channels and are confidential between the “caller” and Danone, unless explicit permission is granted by the “caller.”

5. Additionally, when using “Live Chat,” please do not send any material that is illegal, threatening, defamatory, damaging to reputation, obscene, pornographic, indecent, or any material that may constitute or encourage conduct considered a criminal offense or violate any law.

1. Danone may provide free starter kits and/or samples for certain products from time to time through the Site.

2. Free starter kits and/or samples are only offered to Malaysian citizens with a valid local address in Malaysia.

3. No purchase is required.

4. Applicants must provide the required information in the request form and agree to the terms and conditions to qualify for receiving a free starter kit and/or sample. Danone reserves the right to verify the information provided by the applicant and request proof of identity. Danone reserves the right to cancel incomplete request forms.

5. Each eligible applicant may request only one (1) free starter kit and/or one (1) relevant product sample. Repeat requests by the same applicant for the same free starter kit and/or product sample will be automatically canceled.

6. The requested free starter kit and/or sample will be delivered to the applicant within two to three (2–3) weeks after Danone receives the completed request form. Delivery time for the free starter kit and/or sample is subject to the applicant’s geographic location.

7. Danone will not be responsible for replacing any starter kit/sample that is damaged, lost, destroyed, and/or stolen, including any damage or loss occurring during delivery, negligence, or applicant error. Replacement of free starter kits and/or samples is subject to stock availability.

8. Each applicant shall be fully responsible for any injury, accident, or claim arising from participation in this offer.

9. Each applicant agrees to indemnify, defend, and hold Danone (including its affiliates and subsidiaries) harmless from and against all losses, damages, expenses, and all third-party actions, proceedings, claims, demands, costs, and liabilities arising from participation in this free starter kit and/or sample offer.

10. Danone shall not be responsible for any errors, negligence, delays, communication failures, and/or any failures related to computer systems, telephone lines, servers, online providers, service providers, the Internet, and/or the Site.

11. Danone reserves the right to modify, add, or delete any terms and conditions related to the free starter kit and/or sample offered at any time at its sole discretion without prior notice and may, at its sole discretion, cancel, change, amend, remove, and/or suspend any free starter kit and/or sample offer without prior notice.

1. We do not control, filter, or edit any Content provided by Users where it is posted on or available from our Site. However, we reserve the right, but not the obligation, at our sole discretion and for any reason, to filter, edit, refuse to accept, remove, or relocate any Content submitted to, from, through, or posted on this Site by Users.

2. In return for Danone using your contributions on this Site, you warrant that they are your own original contributions, are not defamatory, do not violate Malaysian law, that you have the right to grant Danone permission to use them without any compensation whatsoever, and that you have obtained consent from anyone identified in your contribution or parental/guardian consent if they are under 18 years of age.

3. You are not permitted to use this Site, or any of our services, for any unlawful, defamatory, harassing, harmful, abusive, or privacy-invading purposes, or for any generally objectionable conduct under applicable law. Specifically, you must not post anything that, in our opinion, could harm the business or offend other Users. You must ensure that you do not transmit to, from, through, or post on this Site any content containing software viruses or harmful files intended to damage or disrupt the proper functioning of computer or telecommunication equipment. You are not permitted to do anything that may interfere with the operation of this Site and its services, or disrupt other Users’ use and enjoyment of this Site and our services. Except as authorized by us, you may not use this Site to organize or manage commercial activities of any kind.

4. Danone has established the following Community Rules so that Users can fully enjoy our Site. These rules aim to protect all Users by ensuring that all communication is safe and enjoyable for everyone:

• Please ensure all your contributions are reasonable and polite.
• No disruptive, abusive, or threatening behavior: contributions must be constructive and courteous, without malicious intent or intent to cause disruption.
• No unlawful or offensive content: content that is illegal, harassing,  defamatory, abusive, threatening, harmful, obscene, indecent, sexual, racially or religiously offensive, or otherwise objectionable is not allowed.
• If you use multiple logins to disrupt the community or annoy other Users, we may take action against your accounts.
• Practice patience: Users may come from all age groups and different abilities.
• When expressing your opinions, please consider their impact on others who may be online at the time.
• This is a Malaysian-based website. Please ensure your posts are in English, Malay, or Chinese so they can be understood by all members and moderators.
• We welcome suggestions for products, books, websites, or other materials you find useful. However, we will take action against contributions we consider advertising or promoting inappropriate (obscene, abusive, etc.) or commercial content. Danone is not responsible for such suggested content.
• Commercial messages and messages from businesses and organizations are not allowed. Our forum is for parents and expectant parents, not a channel for marketing or selling to our Users. Please ensure any product recommendations are based on your personal experience and do not include endorsements or marketing for commercial purposes, where you receive any benefit, monetary or otherwise.
• No impersonation.
• No inappropriate usernames (obscene, abusive, etc.).
• Dugro Community moderators may post messages, intervene, edit, or delete messages from time to time.
• We welcome both positive and negative feedback, but please ensure your comments comply with Dugro Community Rules. If you repeatedly post personal or offensive comments about individuals or companies, it will be considered harassment. We reserve the right to take action against those responsible or assist individuals or companies in taking action against those responsible.
• To ensure you receive accurate information, our advisors will occasionally join Dugro Community discussions.
• Please note: Our Dugro Community may contain comments and discussions by members about infant formula and bottle feeding. All opinions expressed are from individuals using the Site and are not associated with Danone.
• Be cautious and remember that online, someone may not be who they claim to be. Anyone with Internet access can access our Site.
• Think carefully before sharing your personal information. This includes name, address, phone number, mobile number, personal email address, photos, etc.
• Be cautious when meeting individuals you have only contacted online. If you choose to meet them, do so in a public place during the day. For your safety, inform someone of the time and place of your meeting or ask someone to accompany you, at least for the first meeting.
• If you fail to comply with these Dugro Community Rules, you will receive an email explaining why your contribution was removed. This email will also contain a warning that continued failure to comply will result in action against your account(s). Such action may include placing relevant accounts under pre-moderation or suspending your access (temporarily or permanently) to participate in the Dugro Community.
